Backpage Auto Posting Software Scam (BP Sender), Scam Site Targeting Freelance Writers & Advice for Freelance Writers on What to Do If Someone Steals Your Content

This is my saga with the creator(s) of the backpage posting software found at wealth-distributors.info, which used to forward to EZAdBlaster.com (and freelancewritersgold.com, a scam site (see end of this post for info on this)). Other versions of this site are BPDominator.com; BPDominator.net; BPDominator.org; and BPDominator.biz.

FYI, see related posts Ghosted Ads on Backpage: Affiliate Marketers — Are Your Competitors Sabotaging You? and Yuwanda Black: Scam Artist of InkwellEditorial.com, SeoWritingJobs.com, FreeAdsSell.info, NewMediaWords.biz and SeoRealEstateWriter.com.

Note: I just want to say, this is an extremely rare occurrence in affiliate and internet marketing. So, don’t let it discourage you. There’s a lot of money to be made online — and it’s highly unlikely that you’ll ever have this problem.

As I relayed in my story of how I came to use the backpage auto posting software, I started using this software in the summer of 2009 to promote my ebooks (eg, http://FreeAdsSell.info) and some affiliate products. I no longer use the software and no longer promote it as an affiliate. And it’s because of the business practices of the developer. They have:

a) withheld justly earned commissions from me;

b) stolen my original content and put it on a scam site they set up specifically to promote their software (freelancewritersgold.com); and

c) tried to bully and scare me with threats of lawsuits.

After all of this, they STILL wanted me to be their affiliate.

The ORIGINAL emails below detail every interaction I’ve had with them and why I no longer support them or their product.

Following is a precursory recap of why I stopped promoting the backpage auto posting software found at wealth-distributors.info (also sold at RoBotLike.com, BpSender.us, BpSender.biz, BpSender.com, BpSender.net, BpSender.org, BpSender.info) and why I started promoting another backpage auto posting software.

How My Problems with Wealth-Distributors.info and Their BackPage Posting Software (BP Sender) Began

backpage-auto-posting-software-scam-alertPay to Play: The problems started when I didn’t renew my monthly subscription with them and they said that I’d forfeit any commissions I’d earned unless I re-upped my subscription. In essence, in order to get your commissions, you have to continually be subscribed.

As I live outside the USA part of the time, I politely told them that I’d be gone for a spell and would renew at a later date. The initial correspondence (which was quite friendly) is as follows:

Correspondence #1: Fri, Sep 10, 2010 at 11:36 AM

Dear Yuwanda,

Your 2-Mo BpSender Subscription expired yesterday, however you have $50.00+ in commissions on your account.  If you like we can apply your commissions to your subscription and re-activate you, might we suggest our 12-month subscription for $49.95 ?

Sincerely,
Management

My response was as follows:

Sat, Sep 11, 2010 at 5:42 PM; RE Re: 2-Mo. Subscription Expired – Apply Commissions ?

To Whom It May Concern:

No, I would not like to renew my subscription at this time. I will be out of the country for the next couple of months, so won’t be able to use backpage. I will renew at a later date.

Thank you for the offer though.

Sincerely,
Yuwanda

Then, things turned ugly very quickly, as the following correspondence indicates.

[#523763] Affiliate Commissions

Their Response to Me on Sept 12th

Yuwanda Black,

A customer support staff member has replied to your support request, #523763 with the following response:

Commissions coming to a standstill

Your account is “Suspended” and one step away from terminated until you have an active subscription, depending on which plan you choose it’s either $5.00 a month or less.  As a representative of our software we can’t see how that would be a problem for any of our affiliates in that we pay that or more per sale once you have reached the 20% payout, and “YES” we are different from any other affiliate program in that our affiliate program actually works as you know.

Happy Selling,

www.BpSender.info

www.Wealth-Distributors.info

My Response to Them on Sept 12

To Whom It May Concern:

My question still was not answered. What EXACTLY does “suspended mean? I ask again:

1. Does it mean that I won’t/don’t get commissions from customers I’ve referred to you while I’m not subscribed. OR

2. Does it mean that I get credit for them but won’t be paid — even if I reach the payout amount — until/unless I subscribe again?

And can you please explain why you are obviously more than willing to accept payment from the customers I refer to you even when I’m NOT an active subscriber, but would “suspend/put a hold on my commissions”. It’s smacks of fraud, deceit and just downright selfishness on your part.

I don’t care what how “cheap” it is (ie, $5) to keep a subscription going. You’re not turning down the business I send you in the meantime. You’re NOT telling customers I send you, “Sorry, we can’t let you use/buy our software because the affiliate you came through is not an active subsriber, so we’re not accepting any business from her.”

Are you doing this?

Is the business I’m referring you not the VERY SAME BSUINESS I would be referring you if I were an active subscriber?

I mean come on really, are you all that obtuse and customer unfriendly?

What gives?
##

I’m an affiliate for quite a few programs, and I’ve never been one where I had to subscribed to a program in order to receive my commissions. It was less about the $5/month for me than about the fairness of it all. I mean, I was still sending them business, and they were still making money from my efforts, yet they weren’t paying me.

It just didn’t make any sense.

My Second Problem with Wealth-Distributors.info and Their Backpage Posting Software (BP Sender) Affiliate Plan: The Puny Payout in Commissions

I asked them why their payout was so little (only 10%) and to get a payout, you had to reach $100. I mean, some of my payouts from them were literally pennies. It almost seemed like they didn’t WANT affiliates to reach a payout level.

Most affiliate programs I belong to pay in the 25-75% range, with 50% being somewhat of the norm. And, when it is a lower percentage, it tends to be a larger ticket item where you get a decent piece of change when you make a sale.

But not this program. But, as I had an in-built audience for this product, I didn’t even care about that so much. I just wanted to be able to service my customers by recommending software I’d used that worked for me that I could turn them onto.

In spite of this paltry amount, in less than 30 days, I’d sent them over $500 in sales, of which my portion was $53. So I was happy, because again, I have a product that goes hand-in-hand with the site, so anything I made from them was just gravy.

My Third Problem with Wealth-Distributors.info and Their Backpage Auo Poster Software Affiliate Program: They Never Paid Me My Commissions BUT Begged Me to Continue Being an Affiliate

After lot of back and forth, as the following emails highlight, these people never even paid me my commissions. They say it’s because I never reached the payout level of $100, but it’s because they (in my opinion) illegally closed my account when I threatened to have my own version of a backpage auto poster software developed.

Funny thing is, they practically begged me to come back, offering me half of the commissions I’d earned up front ($26+) and they even offered to increase my percentage if I continued to be an affiliate for them.

I’m not making this up folks. Read the emails that follow this recap and you’ll see that everything I’m saying is true.

My Fourth Problem with Wealth-Distributors.info and Their Backpage Auto Poster Software Affiliate Program: Lack of Customer Service

After they made me this offer, instead of warming me to the company again, I ceased communications soon thereafter because in my mind I thought, “These people are crazy. I in no way want to be associated with them or their company.

I mean, how can you go from threatening to sue someone and calling them a fraud, to offering to increase their commissions and give them half what they’ve already earned up front.

It reeked of instability (in company and the mind of the person behind the correspondence to my eyes).

I just wanted to be rid of them.

And that was the end of it. Or, so I thought.

Although I had threatened to publicly out them, once I cooled down I was like, to sling mud, you have to get dirty. And, I don’t like getting dirty. I have a business to run and really no time to indulge in petty “cyber squabbling.”

And then I ran across the scam site FreelanceWritersGold.com with my original content on it (stolen, to promote their product).

I was incredulous!

My Fifth Problem with Wealth-Distributors.info and Their Backpage Auto Poster Software Affiliate Program: Shady Business Practices

I thought to myself, if someone can stoop this low, what other types of business practices are they capable of. When the software first stopped working and I had to sign up with this company to continue to use it, I smelled a rat.

I mean, the company says that they are the original creators of the backpage auto posting software and that others who were using it and selling it were doing so illegally. But, I know a little about software development.

And, this had been going on for some time — at least a six months to a year by my estimation. So if it had been pirated, wouldn’t they have caught on sooner? I mean, when I bought this software, it was all over backpage.com.

My feeling is they developed it, then gave it away or sold copies and gave away all rights. THEN, when they saw how popular it became, they decided to yank the licenses and make it a subscription-based software.

I don’t know this to be the case for sure; this is just my supposition.

Many individuals who used to sell this software suddenly went to use it one day only to find that it didn’t work. This was a pretty shady way for it to happen, which makes me think the software wasn’t pirated at all. In my opinion, they were behind the whole thing.

But, I have to wonder how successful they are promoting it if they’re chasing one “used to be” successful affiliate (me) and going so far as to steal my content and set up scam sites with it on there.

With practices like this, it’s hard to trust that the company behind this backpage posting software are ethical. I mean, one day will you find that your affiliate commissions aren’t being paid, will you ever reach the $100 payout with such a low earning rate (10%), will they raise the rates on their monthly passes prohibitively; will they change how you can use the software?

When a company acts in a skeezy manner, it makes me wonder what they’re capable of on every level.

So, even though I was a one-time happy user and affiliate for this product, I no longer am.

That’s my story with wealth-distributors.info and their backpage auto posting software. Take it for what it’s worth.

Note: See all emails in my back and forth with them in September 2010.

Yuwanda Black,

A customer support staff member has replied to your support request, #523763 with the following response:

The opposite of an “Obtuse” angle is an “Acute” angle, as we have tried to be professional with you, yet you insist on carrying on with your “Rhetoric”.  This is really simple, if less than $5.00 a month is a problem for you then obviously you are not part of the target market that we are trying to reach.  There is no need for us to explain this any further, either you have an active subscription which is required to continue to part of this program or not, we don’t have the time to continue to discuss a less than $5.00 a month matter.

Management

My Reply

My response is not “rhetoric.” It is a valiant effort to get an ACUTE, straight answer from you, which I still haven’t gotten. Can you PLEASE answer my questions and clarify your policies, ie:

1. When will my subscription be cancelled? After 48 hours, 30 days, when?

AND

Regarding my exisiting commissions?  Can you please explain exactly what “commissions come to a standstill means”? While I am not an active subscriber:

2. Does it mean that I don’t get commissions from customers I’ve referred to you while I’m not subscribed. OR

3. Does it mean that I get credit for them but won’t be paid — even if I reach the payout amount — until/unless I subscribe again?

And it’s not about the amount ($5) or whether or not I’m your “demographic; you’re receiving business because of MY toil, and now you’re trying to wiggle out of paying — plain and simple. I know it, and you know it. How can you in good conscious conduct business like this? I’m quite frankly flabbergasted.

If you no longer wish me to be an affiliate, simply pay me my commssions earned to date via PayPal, and we can sever this relationship.

Awaiting your response to my “rhetorically” simple request,

BOUGHT IT & USED IT; HENCE AM ABLE TO 100% RECOMMEND IT HONESTLY — to my grandmother and anyone else who wants to know about it. You obviously do not WANT to pay me (or any of your other hardworking affiliates), or you wouldn’t have these ridiculous policies in place.

WHERE?!

Yuwanda Black,

You were canceled 3-Days ago, if your software is still working there can be only one reason for that which is that you have tampered with our Software and of which gives us valid reason to report you to the “FBI – Federal Bureau Of Investigations Anti-Piracy Unit”.

As of this moment you are terminated from our affiliate program and all commissions are null in void in lieu of your tampering with our software.

Cease & Desist Notice:

Immediately remove all reference of our Software in “PRINT” and / or “Graphic” form from your websites, we will follow-up with notice to the hosting company of www.InkWellEditorial.com and HubPages.com and alert them of any ABUSE planned on your part, in addition to your local State’s Attorney General.

My Response

YOU can threaten me all you want. I haven’t broken any laws and you can follow up with whomever you want (Attorney General, FBI, CIA, KGB and any other worldwide power you please). In fact,  PLEASE, please press forward with your suit.

The only thing I’ve done is send you viable business. I’d love for you to explain to a judge how you willfully and WRONGLY terminated my account, continue to profit from my affiliate efforts, confiscated my earnings and then proceeded to threaten and have the unmitigated gall to sue me.

I WILL NOT remove any reference to your product from my sites until I am good and ready to. Unlike you, I provide an honest service to my readers and customers. Hence, until I find a viable replacement for your software, references to it will remain on my site.

If this offends you, then PLEASE, PLEASE, PLEASE, SUE ME.

And oh yeah, I will definitely be writing about this — and using the correspondence we’ve shared today VERBATIM. Again, SUE ME; just try it. It’s not slander or liable IF IT’S TRUE. And, every word of this is.

I started out happily and eagerly promoting your product. All I asked was for fair treatment in return. And the minute you can’t answer simple questions (which I’m STILL waiting on a response to), you cancel my affiliate account and confiscate my earnings? You people are pieces of work.

If I had the time, I’d sue your asses. For I KNOW I have a case. You gave me no warning before cancelling my account. You fraudently took money away from me. You refused to answer my legitimate, direct customer service questions about when my account would be cancelled and what happens to my earnings in the meantime on THREE SEPARATE occasions. And when you finally get fed up with me asking again and again, you FINALLY tell me that it was cancelled 3 days ago and that the monies I’ve earned are null in void (for the record, it’s “null AND void”) .

Why couldn’t you tell me this in the first place?

Again, I may sue YOUR asses.

As for tampering with your software; wouldn’t dream of it, don’t have the skill or know how to do it and wouldn’t even if I did. As I said, I’m an HONEST business person.

Too bad you can’t say the same.

Now, I’m going to give you one more chance to do the right thing — reinstate my affiliate account until I reach the payout amount. OR, pay me my commisions earned to date. THEN, you can cancel my account and slink off into the sunset.

Otherwise keep in mind that the pen is indeed mightier than the sword.

Sincerely,
Yuwanda Black

Not going to happen, and we will be policing website daily, it would be a good idea on your part to read your contract with your hosting company before you think of any malicious efforts on your part, and our as you put it “Threats” to report you are not “Threats” but “Promises”.

You screwed up asking us when your subscription would be canceled when we have on record that we canceled you 3-days ago.

*STILL awaiting DIRECT answers to my questions, ie:*

1. When will my subscription be cancelled? After 48 hours, 30 days, when,

when, when pleeeeasaassseeee?

Of what were you referring to here ?, your Affiliate account or your “SoftWare” subscription ?, we took this as a reference to your “SoftWare” subscription.  However to give you the “Benefit Of The Doubt” there is a simple test for this, start your BpSender Software and let it run for five minutes, send us a EMail upon starting it and upon terminating it, and this will answer our questions as to your “Honesty”.

If this test proves you to be Honest, sure we will re-instate your Affiliate account, however you will still be required to have a active subscription to continue to receive commissions, rules are rules, and we don’t bend them for anyone, would not be fair to our other Affiliates.

Management

My Response

Did not screw up, and have read the terms of my hosting company contract. No hosting company can’t subvert the First Amendment buddy. FYI, in case you didn’t know, it’s the one that deals with free speech.

As for me screwing up, you may have on record that you cancelled my account 3 days ago, but you failed to inform me of that when I asked you THREE TIMES. Again, why wouldn’t you simply tell me that up front — and reiterate what your policy in this area was. In my opinion, it’s because you had no standing policy and are making it up as you go along.

I’d still love to know what your ahm “policy” is regarding “commissions coming to a standstill.” You STILL haven’t answered that question. Or, have yo formulated one since our last email correspondence ten minutes ago?

I ask again for the FOURTH TIME:

1. Does it mean that I won’t/don’t get commissions from customers I’ve referred to you while I’m not subscribed. OR

2. Does it mean that I get credit for them but won’t be paid — even if I reach the payout amount — until/unless I subscribe again?

It would be helpful for existing affiliates to know this information before they expend any effort on promoting your product

And, FYI, do you block people who aren’t active subscribers from signing up to your program. Again, helpful info for potential affiliates to know.

I can say whatever I want as long as it’s true. And my actions will not be malicious, simply the telling of a true customer service experience with your company and its practices. I’m going to simply explain to the world wide web MY experience with your company. And as I have the emails to back up everything I’m saying, well . . . nothing like blatant PROOF.

So police any website you please and if you feel that I run afoul of any law at any time, feel free to press ahead with your suit. I’d truly welcome it.

Sincerely,

Yuwanda Black

I was referring to my affiiate account.

I have no interest in continuing to be your affiliate under your current setup, and as I can’t get a straight answer from you about your policies, it makes any effort I might expend on your product futile. Beloieve me, I’m actively seeking a replacement. I’ll repeat, as long as I’m sending you paying customers, what difference does it make if I’m subscribed?

The only reason I continue to recommend this software (for the time being) is b/c I haven’t used another like it, so can’t honestly recommend it to my readers/affiliates. Hence, all references on my sites will remain live, again, for the time being.

You guys are gonna lose a lot more customers if you don’t revisit how you do business. I’ve never in my life met an online business with more affiliate unfriendly practices. I wrote a book that goes hand in hand with your product, continue to send you customers (not for your benefit but b/c I have personal experience with it and can honestly recommend it) and this is how I’m treated.

I simply just don’t understand you people.

Not A Problem, we are from the school of there is no such thing as “Bad Publicity”, however, should you fail out test that we just sent you as to starting your BP Sender Software, then we will demand that you immediately remove all reference of selling our software from your websites.

CONVERSATION #8

Yuwanda Black,

Sure other software exists as we are sure you know already, and to be frank this is the exact reason that we make it a requirement that our affiliates have an active subscription, loyalty and honesty. Now we have said that to say this, yes other software exist, however there is none other on the market that is:

CHEAPER

BETTER

FASTER

But we don’t have to tell you this, you already have firsthand experience with our software, the only reason that any person will switch from our software in this current market with our current competitors is for not wanting to pay the less than $5.00 a month subscription cost, and for us that’s the “Acid Test” as to what type of client potential that client would hold point blank, anyone not willing to pay $5.00 a month to advertise their business is someone that we would choose to NOT have as a customer.

Sincerely,

Management

My Response

Customers will switch if they’re not getting the CUSTOMER SERVICE behind the product.

Your customer service policy towards affilaites is abominable. No matter how good your product is, if people feel cheated, misused and abused, then they’ll switch, as I’m actively looking to do.

If your product is good AND your customer serivce is good, then you don’t have to “hold customers hostage” by requiring them to continue to pay. They’ll want to stay — of their own accord.

And not for nothing, people switch products all the time — for their own personal reasons. That doesn’t mean that they shouldn’t be paid for the efforts they’ve put into promoting your product. Again, are you TURNING AWAY any business that I send you, even though I’m not subscribed? No. You’re continuing to profit. And you say you operate with integrity.

Not in my book — or any other honest retailer.

If you really want to prove your integrity, DON’T accept affiliates into your program who are not ACTIVE subscribers. AND, make sure that they know from THE BEGINNING that if they are not active at ANY time they forfeit their commissions. Otherwise, someone could actively promote your products for years, then when they decide to stop, all that hard work is taken away from them.

Ie, all the articles, weblinks, PR pieces, books, etc. with all those ACTIVE LINKS that go right to you — to give you business — is forfeited. You call THAT integrity.

Again, not in my book. That’s more like a bait and switch; in short a con game you pull on affiliates.

I’ve been doing business online since 1999, and I’ve never, ever come across a company with policies as horrific as yours towards affiliates when all I wanted to do was send you business. Again, I don’t understand you people.

I ask again, in good faith as one internet marekter to another, that you rethink this. It’s not a good policy and will eventually catch up with you. In fact, I’m thinkiing of paying someone to create me my own backpage ad posting software. I know it’s a simple script and I could get someone to do it for just a few hundred bucks.

Then, I could give it away if I wanted. But, I would never treat my affiliates like you. Will be interesting to see where you all are in 3 years with these kinds of policies.

I truly wish you the best, as I sit here and continue to shake my head at how anyone can treat someone who’s only sent them business so horribly — over a measly few dollars.

Confusedly,
Yuwanda

CONVERSATION #10

Yuwanda Black,

Our policies are stated in the “Sign-Up” process, we have been on-line since 2006 so as for your 3-Year statement.

Neverless we have sent you half of your “Commissions” via AlertPay which goes against our policies of requiring a $100 payout which you never reached to prove to you that we are a business that “WANTS” to pay our affiliates.

You failed to initial the “SoftWare Test” that we asked of you and that has our eyebrows raised about your “Tampering With Our Software”, of which we take very seriously.

As we have stated to you before, all we ask is an active subscription and upon reaching your payout mark of $100 we always expeditiously pay our affiliates, but understand that we must and always will “Protect” our software.

After you conduct the “SoftWare Test” that we ask of you to prove that your software has not been tampered with we will re-instate you and credit your account for the other half of your commissions thus available upon your reaching your $100 payout limit.  Remember that every 25 sales your commission increases 5% until you reach the 20% max limit.  The other day you had a sale of $129.00 of which we credited your account for $12.90, had you been at the 20% level that would have been more than a $25.00 commission and I don’t have to tell you that there are not many Affiliate programs that are paying over $25.00 per commission, sure there are “Pie In The Sky” offers but our program is real and legit, with the potential to earn even more.

At Any Rate, we will leave the door open for you.

We hope this response has sufficiently answered your questions. If not, please do not send another email. Instead, reply to this email or login to your account for a complete archive of all your support requests and responses.

My Response

Customers will switch if they’re not getting the CUSTOMER SERVICE behind the product.

AS YOU NOTICED WE HAVE ANSWERED EACH AND EVERYONE OF YOUR QUESTIONS EXPEDITIOUSLY, THAT WE CAN GUARANTEE YOU WILL NOT FIND WITH OUR COMPETITORS !

In fact, I’m thinkiing of paying someone to create me my own backpage ad posting software. I know it’s a simple script and I could get someone to do it for just a few hundred bucks.

BASED UPON THIS STATEMENT, THAT DOOR THAT WE HAD LEFT OPEN FOR YOU IS NOW PERMANENTLY CLOSED, YOU ARE NOW VIEWED AS A COMPETITOR !

Management

My Response

You expeditiously answered emails, but you didn’t answer my QUESTIONS.  I’m still waiting for an answer to the questions posed below, which have ben asked in one form or another FIVE TIMES.

You can view me as a competitor all you want; threaten all you want; and huff and puff all you want, but until you answer my LEGITIMATE QUESTIONS, you are nothing but a cyber theif. As for conducting your software test, how dare you question my integrity. Why should I have to “prove” anything to you? I’m still sending you business! You’re the one who has threatened, abused and stolen from ME.

And again, I “recommend” this software b/c I AM an honest retailer who wouldn’t do a disservice to my customers by recommending another product that I haven’t used. Until I find a replacement for this software, I will continue to link to it — whether or not you pay me my JUST referral fees — because again, I AM HONEST and care more about the success of my followers and my reputation as an online marketer than the paltry 10% you pay out.

That percentage alone should clue affiliates in as to how you value their efforts. Most reputable companies pay affiliates 50% and up. Why only 10%? Do you really believe that’s all people who work hard to bring you business deserve? Can you explain this company policy to affiliates?

After all, if not for affiliate efforts, you would not have the sale. In less than a month, I’ve brought you what, over $500 in business? Imagine how hard I wold have worked had it been even 25% or 30%. I have an in-built customer base for this product, yet you cancel my account beause of $5 paltry dollars; because I refuse to be held hostage and pay for a service I can’t use while I’m out of the country.

Real bright business acumen buddy!

Finally, as a customer service gesture to future possible affiliates — as this will be published and I want to give a fair account — can you please answer the following questions. Otherwise, common sense dictates that you have no policies in this area, or that you don’t operate fairly with affiliates and will take commisions they’ve justly earned away from them.

QUESTIONS POTENTIAL AFFILIATES NEED ANSWERS TO

1. If not an active subscriber, does it mean that an affiliate won’t get commissions from customers they’ve referred to you while they’re not subscribed;

OR

Does it mean that they will get credit for them but won’t be paid — even if they reach the payout amount — until/unless they subscribe again?

2. Do you block people who aren’t active subscribers from becoming an affiliate of your program? If not, why not, when they won’t receive commissions according to the correspondence we’ve exchanged today.

3. Where is a link to your affialite program with ALL THE “TERMS OF USE” STATED? The one on your affiliate page (http://www.wealth-distributors.info/affiliates/index.php) as of this writing only states the following. [Note: There’s NOTHING about having to be an active subscriber to become an affiliate; and there’s NOTHING about commissions being forfeited if you are at any time not an active subscriber. And FYI, I’ve made a screen shot of this as of 10:42 EST US on 9/12/2010.]

CONVERSATION #11

Yuwanda Black,

Good Faith payment “CANCELED”, you did not reach the required $100 payout limit, we were trying to demonstrate to you that we always pay our Affiliates even though you never reached the required $100 payout limit.

Early even and not making you wait the required 30 days of being paid for sales generated the previous month.

Yet all you could find to do is “Threaten” us with becoming a COMPETITOR, we are not in the business of financing would-be Competitors.

Not only has your Affiliate account been canceled, but access to our support system will also be canceled as of this correspondence.

Unfortunately we will never allow the “Tail To Wag The Dog” here at our company.

CONVERSATION #12

Yuwanda Black,

A customer support staff member has replied to your support request, #523763 with the following response:

*QUESTIONS POTENTIAL AFFILIATES NEED ANSWERS TO*

1. If not an active subscriber, does it mean that an affiliate won’t get commissions from customers they’ve referred to you while they’re not subscribed;

AS WE HAVE ALREADY TOLD YOU, A AFFILIATE CANNOT BECOME AN AFFILIATE WITHOUT FIRST CHECKING OFF ON THE “TERMS AND CONDITIONS” RAIDO BOX, OR OUR SOFTWARE WILL NOT ALLOW THEM TO BECOME A AFFILIATE.

THE ANSWERS TO ALL OF YOUR QUESTIONS ARE THERE AS WE TOLD YOU ONLY NEED TO PERFORM A MOCK SIGN-UP AND NOT COMPLETE THE PROCESS, OTHER THAN THAT WE ARE FINISH ANSWERING YOUR QUESTIONS.

As for wise decision,

boy, you have no idea who you’re up against or what you’ve done.

SIMPLY BASED UPON YOUR CHARACTER IN THESE EMAILS WE HAVE A GOOD IDEA OF JUST WHO AND WHAT WE ARE UP AGAINST, AND TRUST US WHEN WE SAY WE WILL NOT LOSE ANY SLEEP OVER IT, OUR SOFTWARE SELLS ITSELF BECAUSE AS YOU KNOW IT DOES WHAT IT PROMISE !, END OF STORY !

====== Please reply above this line ======

Yuwanda Black,

Our “Terms & Conditions” are not what you are assuming is listed on the frontpage of the Affiliate website, they are presented to the Affiliate within the sign-up process as we have re-iterated to you three times now.

Management

====== Please reply above this line ======

Yuwanda Black,

As we have stated to you before, what we ask is an active subscription and upon reaching your payout mark of $100 we always expeditiously pay our affiliates, but understand that we must and always will “Protect” our software.

Ie, all the articles, weblinks, PR pieces, books, etc. with all those ACTIVE LINKS that go right to you — to give you business — is forfeited.

If you ever “Choose” to “CONFORM” and present yourself as a good “Foot Soldier” you will need to change your “Affiliate Link I.D.”, your previous I.D. is no longer available, thus meaning you will need to update all of the above-mention links to your “New” I.D. .

You need to remember that you were an “Affiliate” and that’s it, it’s not your place to try and “DICTATE” policy to our company.

My Response

As I previously stated, I have no interest in being your affiliate under your current system. My affiliate link remains live for the convenience of my readers/followers until I can find a replacement software to recommend. I won’t do a disservice to them b/c of your abominable customer service policy toward affiliates. My loyalty is to them, not you or whether I’ll collect on the legitimate business I’m sending your way.

The universe (karma) will take care of you because I’m well aware that you are unwilling to do the right thing and pay me for the paying customers I continue to send your way.

Best,
Yuwanda
Your Profitable (Yet Unpaid) “Affiliate”

CONVERSATION #14

Yuwanda Black,

Of course we are willing to pay you once you reach your $100 limit, current you are at roughly $53.00, that’s why we told you that you will need to change and update your links in your advertisements.

We pay all our affiliates on time and on schedule, without our affiliates there would be no us, however we have to have rules and order, for:

Where there is no Discipline there is no order, And where there is no order there is only chaos.

We run a tight ship, and for that we are not apologetic.

As previously mentioned all we want are Win-Win situations.

Management

Yuwanda Black,

My affiliate link remains live for the convenience of

my readers/followers until I can find a replacement software to recommend.

YOUR AFFILIATE LINK IS CURRENTLY NOT LIVE, THAT IS WHAT WE HAVE BEEN TRYING TO TELL YOU ALL DAY, IF YOU DON’T CREATE A NEW AFFILIATE ACCOUNT AND REPLACE YOUR LINKS YOU WILL NOT RECEIVE CREDIT FOR ANY SALES FROM THIS POINT ON.

AS FOR A REPLACEMENT SOFTWARE, GOOD LUCK WITH THAT, TRUST US WHEN WE SAY THAT WE HAVE BENCHMARKED THEM ALL, YOU SEEM TO TAKE IT FOR GRANTED THAT WE ARE RESPONSIVE TO YOUR QUESTIONS, BUT SOME PEOPLE HAVE TO LEARN FOR THEMSELVES, WE URGE YOU TO GO AND EXPERIENCE THE CUSTOMER SERVICE OF OUR COMPETITORS, YOU THINK WE ARE ROUGH AROUND THE EDGES AT TIMES, ARE YOU EVER IN FOR A RUDE AWAKING, THAT IS IF YOU EVEN GET A RESPONSE OUT OF THEM AT ALL.

Happy Hunting,

Are you insane thinking you can use “Graphic Photos” of our software to sell another software that does not even provide you with photos, there is not one photo on their website, so yet you think you can use photos of our BpSender software.  You will be hearing from our Legal Department shortly, and I can guarantee you that it will not be in a pleasant way.  Before it’s all over we will own www.InkWellEditorial.com

CONVERSATION #16 (from them to me)

Not to mention that it’s “FRAUD” that you are perpetrating upon your readers thinking that they are receiving the BP Sender software only to discover later that you have pull a “Bait & Switch” Fraud game on them using our Photos of BP Sender, we will be writing an Article about the Fraud that www.InkWellEditorial.com is practicing upon it Readers or should we say Victims.

Our first thoughts out of pity was to offer you 25% and allow you to continue to be an affiliate out of concerns for your readers and try and keep you happy, but we have dealt with Affiliates like you before that think that because you make some sales that you can dictate policy to us, long story short “Enough Is Never Enough”, first it’s 25%, then you want 50%, and we are not even going to start those games.  Instead we will simply let our Legal Department deal with you.

Might be interesting to write an Article as to how www.InkWellEditorial.com perpetrates FRAUD upon it’s readers, someone has to protect the “Public At Large” from Internet Frauders such as yourself.

You will hear from us shortly.

CONVERSATION #19 (My Response to Their Complaint)

Sunday, September 19, 2010 11:15 PM: Subject: Re: “DMCA Complaint” – ABUSE – Copyright & TradeMark Infringement – www.InkWellEditorial.com

To Whom It May Concern:

All graphics related to this company’s software has been removed from my sites. I’ve replaced it with the graphics of the software I now do support.

I have not removed textual references, as they are true accounts of MY experience with the software and the site (backpage.com), which is covered under the First Amendment (ie, free speech).

Note: This entity had no problem with me until I started promoting a competitor’s product. While I was researching and checking out alternatives, I STILL sent this company business because my loyalty is/was to my followers/readers/subscribers. [[As an affiliate marketer, I don’t just willy nilly recommend products. I check them out first to be sure that they work aand are legitimate products and services from legitimate companies.]

This entity only filed this complaint AFTER I stopped promoting their product — and starting promoting a competitor’s product.

Sincerely,
Yuwanda Black, Publisher
InkwellEditorial.com

10/18/2010 Addendum/Disclaimer: The website, backpage.com, is in no way party to the situation outlined here. I use the site and heartily recommend it. My problems are with one Carl Williams and his websites (wealth-distributors.info, bpsender.info, Robotlike.com, et al) and business practices.

CONVERSATION #20: They Offer to Increase My Commissions

Monday, September 20, 2010 2:34 AM

Thank-You,

For showing us that you can conform when you have to, and with that display of conformity to show our good will we are willing to accept you back into our Affiliate Program at the 20% level.  As you may know normally Affiliates are incrementally advanced at 5% increments every 25 sales until they reach our max of 20% commission.

However again as a show of good will on our part we are willing to double your previous 10% commission and catapult you to the 20% level our max commission, thus by-passing the required 25 sales at the 15% level.  The school of sales we are from would stand to reason that it’s better to have 20% of a popular selling product versus 25% of a un-popular product that no one has every heard of.

Another sales adage is that one can have the best product or service in the world, but no one is going to buy anything from someone that they don’t like, or in short, “Business comes down to one word, “Relationships”.  Fortunately for us here as Programmers, not SalesPeople, as you know our BP Sender software sells itself.

This is our last offer to you, and it stands valid for the next 24-Hours, our re-actions to your actions were in no way to cause you financial harm, but understand that we could not idly standby and allow you to use our “Intellectual Property, ie: graphics” to sell another software, business is business, nothing personal.

Management,

If all of MY content is not removed from this site IMMEDIATELY, I will be taking legal action.

Look, I just want to be left alone from you; I don’t want to promote your product and I don’t want you stealing MY content to promote your product.

I was going to leave this whole situation alonne, but if you don’t remove my content and stop contacting me to promote yours, I will be taking legal action, as well as publicly exposing you and your business practices MR CARL WILLIAMS.

Now go and have a “Beef Patty” or “Cury Goat Patty”, or some Cury Chicken, or Ackee & SwordFish, or maybe some Red Beans and rice whatever your preference, and don’t forget to “Have A Coke & Smile”, it’s expressly for this reason that I don’t date Sisters or Black Woman anymore, any other questions ?, strictly Latina Senoritas, for that fact have a Baby on the way now from my precious Senorita !, and plan to pass that same advice on to my Sons, Black Women / Sisters are nothing but problems, the same reason the Black Man has never been able to accomplish anything, even during slavery in the USA the Black Woman was laid up in bed with Master and to this day she has not changed.

Maybe Minister Ferakann could explain better for you !, but I’m not Muslim, I’m 3rd Degree Master Mason (Masonic) and have plenty of Brothers there in Jamaica.

Or maybe you prefer some “Jerk Chicken”, I have to admit it is delicious, at any rate take care “Sister Girl”, it’s been a pleasure knowing you, would have rather had you as a friend than a foe, but as I have said before I understand “Jamaicans”, I’m not beating my head against that wall again.

Also for the record, Jamaica does not have a patent on “DreadLocks”, Jamaica is only “Part Of” the Caribbean, of which so is Florida, you only have to cross the small strait of ocean that separates Jamaica from Miami, Florida and you will find plenty of American “DreadLocks” right there in my beautiful Miami, and as you know they take life very serious, but I forgot you chose to live in Jamaica it is cheaper there, unfortunately everyone can’t afford to live in Miami.

And when I say “Cheaper”, I mean “Third-World” conditions, who would “Choose” to live there ?

Miami, Florida and you will find plenty of American “DreadLocks” right there in my beautiful Miami !

That is, “EDUCATED DREADLOCKS !”, that’s where we differ from the Dreads you are accustom to.

I have to remember you are a Writer so I’m correcting my spelling, that’s “Past” not “Pass”, as in what you are to us now, “Past Tense”, you remind me of my High School English Teacher.

But one thing that I will give Jamaican women is that they are “Incredibly Beautiful”, guess that explains why I have two kids from one, but if you noticed Ms. Jamaica came in second place to Ms. Mexico in the “Ms. Universe” contest pageant, it would appear that I made the right choice in putting the Jamaican women “Behind” me and moving forward with the other minority woman, the Latina woman who are also incredibly “Beautiful”, the mix should be even more interesting when she has my child in four (4) months. Got to go, have fun, Sister !

Happy Trails,

And furthermore as you know and as we know your chosen choice of software does not even post to BackPage effectively, so in the end what did you gain by acting like a fool and trying to be greedy, now you have “Nothing” coming, just a sad memory !

You can’t make this stuff up folks!

Freelance Writers – Someone Steal Your Content? File a Civil Suit

I’m now in the process of filing a civil suit against this guy because he seems hell bent on not leaving me alone.

The moral of this story is, sometimes you have to make an example out of people. I was never going to discuss my dealings with this company, because I run a legitimate business and am way too busy to be bothered with stuff like this.

I’ve spent my whole morning dealing with this stuff; time that I could have spent on so many other things (eg, the ebook writing and publishing tournament my site is currently hosting).

But when he actually stole my content, I said to myself, “He’s gone too far; it’s time to take a stand.” I’ve seen my stuff stolen before (blog posts, articles I’ve written, etc.). And, it seems to be happening more and more and quite frankly I’m sick of it.

There’s a lot of money to be made in affiliate marketing (which I use backpage for), but it’s hard work. Writing is hard work. I just can’t sit back and let this continue to happen, which is why I’m moving ahead with a civil suit.

    1. WOW! Thank you for taking the time to post all of that drama! It’s a great inside look on how ugly things can get, and how low it can go. My sympathies to you, but my thanks as well for turning your horror story into a warning and learning opportunity for others.

    2. @Ari: You are tooooo funny. As a born and raised “southerner,” I hadn’t heard that word in years (cracker).

Thank god we all progress beyond our upbringings, no?

Thanks for the support. Much appreciated. 🙂

    3. Yuwanda, I’m completely flabbergasted AND offended by the deranged rantings of this individual! Yes, I WAS considering purchasing a subscription. Now? Nah, now I’d just as soon pound mah money down a rat hole.

Mr. Williams? Should you happen to read this, you should also know that your ethnic/racial slurs slung at Jamaicans in general and Yuwanda in particular offend this “cracker”, ya nit.

    4. @Cheryl Lynn: Right! It is one of those, “truth is stranger than fiction” tales.

@J. Dabin: I know (RE the supposed sales and his bitterness).

I mean, if you’re working hard to build your business online, you just don’t have time to behave like this.

      Thanks for the support. 🙂

    5. This person is very bitter. He needs to seriously get a life. If he was smart, he would have given the commission you deserve. Very unprofessional! BTW, there is no way he could have gotten sales from the bad publicity.

    6. This is the most incredible thing I’ve ever seen! How can people be so dense? Those guys are nuts! I felt like I was in the twilight zone when they offered to have you back as an affiliate. WOW!

I hope your civil suit is successful.

    7. @Karen Cioffi: Thanks for the feedback; will include in post tomorrow. Sorry I couldn’t be of more help.

Maybe after tomorrow’s post someone else can chime in with more info.

@LS: My sentiments exactly. I’m STILL flabbergasted.

@Ruth: Ya know, I tried NOT to go this route b/c as I said, I’m so busy. But, there’s a time to take a stand, and when someone steals my hard-earned words, that’s it.

And good for you! I think we’re going to be seeing more of this as the web gets more crowded and lazy people get more desperate.

Most don’t like to write, so they’ll steal content from others without even thinking about it. Hence, freelance writers who depend on their words for a living must become more vigilant.

@Mary: It already does. You type in any form of backpage posting software (and his company name), and something written by me comes up.

As I said to him, the pen is indeed mightier than the sword. It has never been more applicable than here.

Thanks for all of your support. I knew this message would hit home with you guys b/c we’re all in the same boat.

Freelance writers are an awesome bunch!

    8. I hope this ranks on SEO for his name and company that would be awesome.

    9. Wow! What a waste of time and space those guys are! And talk about unprofessional…

You must have wasted a horrible amount of time on them. I recently had a legal run-in with someone online and had to engage an attorny in the US (I’m in Australia)to deal with it all. It just took up too much of my time and money, but I won in the end which was a sweet victory in the end.

I must be like you because I won’t roll over and play dead either just because someone threatens me. I come out all guns blazing because I’m an honest person and I have nothing to hide, so anyone who comes up against me is the dishonest one.

Good for you for sticking up for yourself. It was hilarous about the e-card and the offer for you to STILL be an affiliat for them. Were you touched? I know they are.

    10. Wow, I wish you luck in the suit. That is a ridiculous way to treat any customer or affiliate. There is no business so big that they can act that way and stay in business- but from a small business? Just wow.

    11. Boy, you’ve had your hands full, the company sounds extremely unprofessional. I have question though, I’ve found 2 sites (I think foreign) that have reprinted my articles. The first edited the the article before posting it; the finished product is horrible and my name is attached to it. The second site is using my name and article titles to try and sell products. What would you do about this situation?

    1. […] The reason Mr. Williams started attacking me and ghosting my ads is because I used to be an affiliate for his product. But because we had a disagreement (which is laid out in this post in detail: https://inkwelleditorial.com/backpage-poster-software-scam). […]
